What the authority has actually said and done

ACM examined roughly 100 of the largest Dutch webshops and found that 61% were not digitally accessible.

On those 61%, it was impossible to place an order using assistive technology. A further 33% of the sites tested had serious problems.

ACM points companies to what needs fixing and involves people with lived experience in its supervision. Companies that do not improve enough risk enforcement.

What this means for your site

The failure that ACM measured is the one that costs money directly: a customer who cannot complete an order. That failure lives in the cart and checkout, not on the homepage.

The standard being tested

Dutch law implements the European Accessibility Act, and conformance is assessed against the harmonised standard EN 301 549 v3.2.1, whose clause 9 adopts the WCAG 2.1 Level AA success criteria. That is the clause numbering an authority cites, and it is what this tool reports against.
